2019/1009 - Regulation (EU) 2019/1009 of the European Parliament and of the Council of 5 June 2019 laying down rules on the making available on the market of EU fertilising products and amending Regulations (EC) No 1069/2009 and (EC) No 1107/2009 and repealing Regulation (EC) No 2003/2003 (Text with EEA relevance) Harmonized Directive
Regulation (EU) 2019/1009 establishes harmonised rules for the marketing of EU fertilising products, including those derived from recycled and organic materials, to promote resource efficiency, circular economy, and reduce dependency on non-EU nutrient sources. It expands the scope to products that improve plant nutrition efficiency, facilitating their free movement within the internal market under CE marking. The regulation categorises fertilising products and their components by function and material type, imposing specific safety, quality, and process requirements, including limits on contaminants such as cadmium to protect human, animal, and environmental health. National provisions may be maintained under certain conditions. The Regulation amends related legislation (Regulations (EC) No 1069/2009 and (EC) No 1107/2009) to integrate these new rules while excluding certain products like untreated animal by-products and plant protection products with overlapping functions. It aims to foster innovation and sustainability in fertiliser production while ensuring consistent public health and environmental safety standards across the EU internal market.
Purpose
Regulation (EU) 2019/1009 establishes harmonised rules for the making available on the internal market of EU fertilising products. It replaces Regulation (EC) No 2003/2003 to expand the scope beyond traditional mineral fertilisers to include products made from recycled and organic materials. The regulation aims to:
- Facilitate free movement of fertilising products within the EU by introducing harmonised standards and the CE marking.
- Support circular economy objectives by promoting the use of recycled nutrients.
- Ensure safety, environmental protection, and high quality standards for fertilising products.
- Encourage innovation in fertiliser technologies, including cadmium reduction.
- Enable products that improve plant nutrition efficiency, such as inhibitors and plant biostimulants, to enter the market under a harmonised framework.
Key Obligations
- Harmonisation and Optional CE Marking: Fertilisers can be marketed either under harmonised EU rules (with CE marking) or under national law without harmonisation. Only CE-marked products benefit from full free movement on the internal market.
- Product Categories and Safety Requirements: Fertilising products are divided into product function categories, each with specific safety and quality requirements. Products with multiple functions must meet all relevant criteria.
- Component Materials Requirements: Raw materials for fertilising products are categorised with specific process and control requirements.
- Contaminant Limits: Maximum levels are set for contaminants like cadmium to protect human, animal, plant health, and the environment. National stricter limits may remain temporarily following notification and scrutiny by the Commission.
- Animal By-Products: Derived products that reach an endpoint in manufacturing and pose no significant risks are excluded from Regulation (EC) No 1069/2009 and covered under this regulation, provided risks are managed.
- Biostimulants and Inhibitors: Products aimed solely at improving plant nutrient use efficiency or delaying nutrient release are included and require compliance with efficacy and safety criteria.
- Exclusions: Plant protection products covered by Regulation (EC) No 1107/2009 and certain untreated animal by-products are excluded.
- Environmental & Health Laws Compatibility: This Regulation applies without prejudice to other EU legislation protecting human health, animal and plant health, and the environment.
Affected Products and Actors
- Products Covered: EU fertilising products including mineral, organic, organo-mineral fertilisers; products based on recycled materials; fertilisers containing inhibitors or plant biostimulants; fertilising blends; recovered waste products like struvite and biochar.
- Manufacturers and Importers: Must ensure compliance with harmonised standards to affix CE marking if opting for placing products on the market under EU harmonisation.
- National Authorities: Responsible for market surveillance and ensuring that non-CE marked products comply with national laws and free movement rules.
- Operators Using Animal By-Products: Compliance with endpoint definitions and safety requirements is essential for products derived from animal materials.
- Commission: Tasked with defining delegated acts as needed for material categories, monitoring national provisions on contaminants like cadmium, and ensuring a coherent legal framework.
Implementation Timeline

Frequently Asked Questions
An EU Regulation is a binding legislative act that must be applied in its entirety across the European Union. Unlike directives, regulations do not need to be transposed into national law and are directly applicable in all member states. Regulations are used when uniform application across all EU countries is essential.
Regulation 2019/1009 covers "Regulation (EU) 2019/1009 of the European Parliament and of the Council of 5 June 2019 laying down rules on the making available on the market of EU fertilising products and amending Regulations (EC) No 1069/2009 and (EC) No 1107/2009 and repealing Regulation (EC) No 2003/2003 (Text with EEA relevance)". This legislation has harmonized European standards (hENs) that provide a presumption of conformity with its essential requirements. There are 500 standards associated with this regulation.
Harmonized standards under 2019/1009 are European standards (ENs) developed by CEN, CENELEC, or ETSI in response to a mandate from the European Commission. When these standards are cited in the Official Journal of the European Union, products manufactured in conformity with them benefit from a presumption of conformity with the essential requirements of 2019/1009, facilitating CE marking and free movement within the European Economic Area.
