Zweck

Wesentliche Pflichten
Pflichten der Lieferanten
- Jedes Gerät muss mit einem gedruckten Energieetikett geliefert werden, das die Energieeffizienzklasse gemäß den Vorgaben in der Verordnung (Anhang II und III) ausweist.
- Bereitstellung eines Produktdatenblatts mit spezifischen Leistungsdaten (mindestens für eine Kombination von Innen- und Außeneinheit).
- Elektronische Verfügbarkeit technischer Unterlagen für Marktüberwachungsbehörden.
- Bei Werbung und technischem Werbematerial mit energie- oder preisbezogenen Angaben ist stets die Energieeffizienzklasse anzugeben.
- Bereitstellung von Gebrauchsanweisungen.
- Einkanalgeräte sind auf Verpackung und in sämtlichem Werbematerial als „lokale Klimageräte“ zu bezeichnen.
- Die Etikettengestaltung folgt einem definierten Zeitplan mit sukzessiver Einführung strengerer Energieeffizienzklassen (von A bis A+++).
Pflichten der Händler
- Sicherstellung, dass in Verkaufsstellen die Energieetiketten sichtbar an den Geräten angebracht sind.
- Bei Angeboten, bei denen das Gerät nicht ausgestellt ist (z.B. Fernabsatz), müssen ergänzende Informationen bereitgestellt werden.
- Angaben der Energieeffizienzklasse bei Werbung und technischem Werbematerial für Modelle.
- Einkanalgeräte sind vom Händler ebenfalls als „lokale Klimageräte“ zu kennzeichnen.
Mess- und Nachprüfverfahren
- Die Ermittlung der Energieeffizienz und sonstiger Informationen erfolgt mittels zuverlässiger, genauer und reproduzierbarer Messverfahren gemäß Anhang VII.
- Marktüberwachungsbehörden kontrollieren die Einhaltung mit Nachprüfverfahren nach Anhang VIII.

- Splitgeräte mit moderner Invertertechnik (neue Effizienzskala von A bis G, Erweiterung bis A+++).
- Einkanal- und Zweikanal-Luftkonditionierer mit separaten Effizienzskalen (A+++ bis D), da hier keine Invertergeräte verfügbar sind.
Betroffene Akteure
- Lieferanten (Hersteller und Importeure) müssen Etiketten, technische Informationen und Verbraucherdaten bereitstellen.
- Händler sind verpflichtet, die Kennzeichnung in Verkaufsstellen anzuzeigen und entsprechende Informationen in Werbung zu verwenden.
- Marktüberwachungsbehörden der Mitgliedstaaten kontrollieren die Einhaltung der Verordnung.
Umsetzungszeitplan
- Veröffentlichung der Verordnung: 4. Mai 2011.
- Inkrafttreten: 20 Tage nach Veröffentlichung.
- Geltungsbeginn: 1. Januar 2013.
- Ab 1. Januar 2013 müssen neue Geräte mit dem neuen Etikett versehen werden, ältere Geräte dürfen noch nach der bisherigen Richtlinie 2002/31/EG in Verkehr gebracht werden.
- Staffelung der Etikettengestaltung und Erweiterung der Effizienzklassen:
- Ab 1. Januar 2013: Einführung der Grundskalen für Luftkonditionierer (A bis G, A+++ bis D bei Kanalgeräten).
- Januar 2015, 2017 und 2019 erfolgen weitere Anpassungen und Erweiterungen der Effizienzklassen zum Ausbau des A+++ Bereichs.
- Fünfjährige Überprüfung der Verordnung durch die Europäische Kommission, um technische Fortschritte und Marktveränderungen zu berücksichtigen.
Die Verordnung gilt unmittelbar in allen EU-Mitgliedstaaten und stellt somit einen verbindlichen Rechtsrahmen für die Energiekennzeichnung von Luftkonditionierern dar.
Die Verordnung gilt für netzbetriebene Luftkonditionierer mit einer Nennleistung von bis zu 12 kW Kühlleistung oder Heizleistung bei Produkten ohne Kühlfunktion. Ausgenommen sind Luftkonditionierer, die keine elektrische Energie nutzen oder bei denen der Wärmeträger auf der Verflüssiger- und/oder Verdampferseite keine Luft ist. Die Verordnung richtet sich an Hersteller, Lieferanten und Händler und verpflichtet zur Energieverbrauchskennzeichnung sowie zur Bereitstellung ergänzender Produktinformationen. Sie umfasst sowohl Einkanal- als auch Zweikanalgeräte sowie Splitgeräte, soweit diese die genannten Leistungsgrenzen nicht überschreiten. Sie dient der Förderung energieeffizienter Technologien im Haushalts- und Gewerbesektor.
Le règlement délégué (UE) n° 626/2011 complète la directive 2010/30/UE relative à l'étiquetage énergétique des climatiseurs électriques d'une puissance nominale jusqu'à 12 kW. Il remplace la directive 2002/31/CE et vise à améliorer l'information des consommateurs sur la consommation d’énergie des climatiseurs, en harmonisant les étiquettes avec des classes d’efficacité énergétique de A+++ à G selon le type d’appareil, prenant en compte l’efficacité saisonnière surtout pour les climatiseurs à technologie inverseur. Le règlement impose aux fournisseurs de fournir une étiquette imprimée, une fiche produit et une documentation technique, et encadre les responsabilités des distributeurs concernant l’affichage sur le point de vente et la publicité. Il prévoit également la mention du niveau acoustique comme donnée importante pour les consommateurs. Les modalités de mesure et de vérification sont précisées pour garantir la fiabilité des informations. Objet
Le Règlement délégué (UE) n° 626/2011 complète la directive 2010/30/UE en établissant des exigences relatives à l’étiquetage énergétique des climatiseurs à usage domestique. L'objectif principal est d'informer les consommateurs sur la consommation d'énergie des climatiseurs, d'encourager les fabricants à améliorer leur efficacité énergétique et de favoriser l’adoption de technologies moins consommatrices d’énergie au sein de l’Union européenne.
Obligations clés
Fourniture d’une étiquette énergétique : Chaque climatiseur doit être fourni avec une étiquette imprimée conforme aux formats et catégories d’efficacité énergétique (de A+++ à G selon les types), visible sur l’emballage ou, en l’absence de combinaison d’unités, accessible en ligne.

Informations additionnelles : Le niveau sonore (puissance acoustique) doit également être indiqué sur l’étiquette.
Dénomination spécifique pour climatiseurs à simple conduit : Ces appareils doivent être désignés « climatiseurs locaux » sur tous supports (emballage, documentation, publicité).
Responsabilités des distributeurs : Ces derniers doivent s’assurer que l’étiquette est visible sur le lieu de vente, que les informations sont fournies lors de la vente à distance ou location, et veiller à la bonne communication de la classe énergétique dans les publicités.
Produits et acteurs concernés
Produits visés : Climatiseurs électriques fonctionnant sur secteur ayant une puissance nominale inférieure ou égale à 12 kW pour la fonction refroidissement (ou chauffage si refroidissement absent). Sont exclus les climatiseurs alimentés par d’autres sources d’énergie que l’électricité et ceux dont le fluide caloporteur n’est pas l’air.

- Fournisseurs : Doivent apposer les étiquettes, fournir la documentation complète et garantir la conformité des informations.
- Distributeurs : Responsables de la mise en évidence des étiquettes et de la diffusion correcte de l’information pour les consommateurs.
- Autorités nationales et Commission : Chargées de la surveillance du marché et de la vérification du respect des normes.
Calendrier de mise en œuvre
Entrée en vigueur : 24 mai 2011 (vingtième jour après publication au Journal officiel de l’Union européenne).
Application obligatoire à compter du : 1er janvier 2013.
Abrogation de la directive précédente : Directive 2002/31/CE abrogée à compter du 1er janvier 2013.
Évolution des étiquettes :
- Dès 2013, introduction d’étiquettes avec classes A à G pour la majorité des climatiseurs.
- À partir de 2015 : ajout des classes A+.
- À partir de 2017 : introduction progressive des classes jusqu’à A+++.
Réexamen prévu : La Commission devra réviser le règlement au plus tard cinq ans après son entrée en vigueur, afin de tenir compte des progrès techniques et évolutions du marché.
Ce règlement vise donc à harmoniser et renforcer l’information énergétique au consommateur, tout en stimulant l’amélioration technologique dans le secteur des climatiseurs domestiques au sein de l’UE.
Le règlement (UE) n° 626/2011 s'applique aux climatiseurs air-air fonctionnant sur secteur, ayant une puissance nominale inférieure ou égale à 12 kW pour le refroidissement, ou pour le chauffage si l'appareil ne dispose pas de fonction de refroidissement. Il couvre notamment les climatiseurs dotés de fonctions additionnelles telles que la déshumidification, la purification, la ventilation ou le chauffage par résistance électrique d'appoint, ainsi que les appareils utilisant de l'eau comme fluide caloporteur à condition qu'ils puissent aussi fonctionner uniquement à l'air. Le règlement exclut les appareils alimentés par des sources d'énergie autres qu'électriques ainsi que ceux dont le condenseur ou l'évaporateur n'utilisent pas l'air comme fluide caloporteur. Il définit aussi les spécificités d'étiquetage énergétique pour différents types de climatiseurs, comme les climatiseurs à simple et à double conduit, afin d'inciter les fabricants à améliorer leur efficacité énergétique.
Delegirana uredba Komisije (EU) št. 626/2011 dopolnjuje Direktivo 2010/30/EU glede energijskega označevanja klimatskih naprav z nazivno močjo za hlajenje do 12 kW. Namen uredbe je zagotoviti enotne in natančne informacije o energetski učinkovitosti teh naprav, kar omogoča potrošnikom bolj informirane odločitve ob nakupu. Uredba uvaja nove lestvice energijskih razredov učinkovitosti A+++ do G, pri čemer so upoštevane sezonske meritve učinkovitosti, zaradi realnih pogojev uporabe. Za eno- in dvokanalne klimatske naprave, ki nimajo pretvornikov, se uporablja posebna lestvica. Poleg energetske učinkovitosti se označi tudi raven hrupa. Dobavitelji so dolžni zagotoviti nalepke, podatkovne kartice, tehnične dokumentacije ter informacije v oglaševanju. Trgovci morajo nalepke jasno prikazati na napravah in zagotavljati relevantne informacije tudi pri prodaji na daljavo. Uredba je začela veljati 1. januarja 2013 in razveljavlja Direktivo 2002/31/ES, s čimer spodbuja razvoj energetsko učinkovitih tehnologij in zmanjšanje porabe električne energije v EU.
Namen
Delegirana uredba Komisije (EU) št. 626/2011 dopolnjuje Direktivo 2010/30/EU in določa zahteve za energetsko označevanje klimatskih naprav, s ciljem izboljšati energetsko učinkovitost in zagotoviti kupcem bolj natančne primerjalne informacije. Uredba spodbuja proizvajalce k nadaljnjemu izboljševanju učinkovitosti klimatskih naprav ter pospešuje prehod na tehnološko napredne in energetsko varčne modele. Z uvedbo novih lestvic učinkovitosti in metod merjenja bolj realno upošteva dejanske pogoje uporabe klimatskih naprav. Prav tako je cilj zmanjšati porabo električne energije zaradi klimatskih naprav, kar ima pomemben vpliv na skupno porabo energije v gospodinjstvih in poslovnih prostorih EU.
Ključne obveznosti
Dobavitelji morajo zagotoviti:
- Tiskano energijsko nalepko, ki vključuje razrede energetske učinkovitosti, na embalaži zunanje enote klimatskih naprav (razen za eno- in dvokanalne naprave lahko tudi prek spletne strani).
- Podatkovno kartico izdelka z relevantnimi informacijami o učinkovitosti in drugi tehnični dokumentaciji na zahtevo državnih organov.
- V oglasih, na spletnih straneh in v tehničnem/promocijskem gradivu navajati razred energetske učinkovitosti, pri čemer je za različne kombinacije klimatskih naprav potrebno navajati tudi učinkovitost za povprečno sezono ogrevanja.
- Jasno označevanje eno- in dvokanalnih klimatskih naprav kot „lokalne klimatske naprave“.
- Zagotoviti navodila za uporabo za vsak model klimatske naprave.
Trgovci morajo:
- Na prodajnem mestu poskrbeti za jasno vidno nalepko na vsaki prikazani klimatski napravi.
- Pri prodaji na daljavo, najemu ali nakupu na obroke zagotoviti informacije v skladu z določbami uredbe, če končni uporabnik ne vidi razstavljenega izdelka.
- V oglasih navajati razred energetske učinkovitosti.
- Pri tehničnem promocijskem gradivu zagotavljati informacije o razredih učinkovitosti in navodilih za uporabo.
- Označevati eno- in dvokanalne naprave kot lokalne klimatske naprave v dokumentaciji in promociji.
Merilne metode za določanje učinkovitosti morajo biti zanesljive, natančne in ponovljive, skladne z mednarodnimi in evropskimi harmoniziranimi standardi.
Za nadzor nad trgom so določeni postopki preverjanja skladnosti deklariranih podatkov o energetski učinkovitosti, porabi energije in emisijah hrupa.
Komisarija bo uredbo najpozneje pet let po začetku veljavnosti pregledala in po potrebi posodobila glede na tehnološki razvoj.
Obseg in zadevni proizvodi ter akterji
- Uredba se nanaša na klimatske naprave, ki uporabljajo električni napajalni vir in imajo nazivno hlajilno moč največ 12 kW oziroma nazivno ogrevalno moč, če naprava nima funkcije hlajenja.
- Izključene so klimatske naprave, ki uporabljajo neelektrične vire energije ter tiste, kjer kondenzator ali uparjalnik ne uporabljata zraka za prenos toplote.
- Uredba pokriva različne tipe klimatskih naprav:
- Deljene klimatske naprave z zrak-zrak ciklom.
- Enokanalne in dvokanalne klimatske naprave.
- Vključeni so proizvajalci/dobavitelji in trgovci, ki so zavezanci k izpolnjevanju zahtev glede označevanja in obveščanja kupcev.
- Končni uporabniki so kupci klimatskih naprav, ki jim te informacije zagotavljajo boljšo možnost za ozaveščen in premišljen nakup.
Časovni okvir izvajanja
- Direktiva 2002/31/ES je s 1. januarjem 2013 razveljavljena.
- Delegirana uredba 626/2011 začne veljati dvajseti dan po objavi v Uradnem listu EU.
- Uredba se uporablja z dnem 1. januarja 2013.
- Po 1. januarju 2013 so se uvedle nove nalepke z razredi energetskih razredov (od A do G z nadaljnjimi dodatki „+“, s postopnim izboljševanjem lestvice do A+++ v letu 2019).
- Oblika nalepk in njihova vsebina se postopoma posodabljata glede na datum uvedbe na trg in tip klimatske naprave.
- Komisija bo uredbo najmanj enkrat pregledala pet let po začetku uporabe, torej pred rokom 2018, da oceni potrebo po posodobitvah glede na tehnološki razvoj.
Uredba z enotnim sistemom označevanja, jasnimi tehničnimi merili in obveznostmi za dobavitelje in trgovce bistveno pripomore k večji energetski učinkovitosti klimatskih naprav in spodbuja ozaveščenost kupcev v EU.
